In 1995, Elena Kagan wrote a law review article praising the attacks on Robert Bork during his confirmation hearings for the Supreme Court. Bork was nominated for the Supreme Court in 1987 by Ronald Reagan, but his nomination failed after contentious confirmation hearings. In the article, Kagan wrote that Bork’s hearing should be a “model” for all others, because even though it ended in the candidate's rejection, the hearings presented an opportunity for the Senate and the nominee to engage on "controversial issues" and "educate the public".  ABC News' article misrepresents her attacks on Bork as "praise".

Republican lawmakers are calling on the Interior Department to stop charging what they describe as "extortion" money from the Border Patrol -- millions of under-the-radar dollars meant to cover environmental damage stemming from their everyday duties along the U.S.-Mexico border. The Department of Homeland Security, which houses the Border Patrol, last year signed a deal with Interior -- the administrator of America's parklands -- to cough up $50 million for environmental "mitigation" needed in the wake of the construction of a border fence. That was after DHS had already spent or committed millions more for expected environmental damage

The Federal Communications Commission (FCC) voted on Thursday to begin the formal process of bringing the Internet under greater federal control – a move sought by both President Barack Obama and FCC Chairnman Julius Genachowski--even though federal law calls for an Internet "unfettered by Federal or State regulation."  This step comes after the federal D.C. Circuit Court of Appeals in April rebuked the FCC in its attempt to enforce a controversial regulatory doctrine called Net Neutrality, which would allow the government to prevent private Internet providers from deciding which applications to allow on their networks.

The Obama administration issued strict rules Monday under which even some small changes to existing health care plans will make them subject to the requirements of the new health care reform law. The president promised repeatedly during the health care debate that individuals who like their current plans would be able to keep them. To meet that goal, the health care law envisioned that some plans would be “grandfathered in” under the old law — and therefore would not be required to meet some of the mandates of the new law, such as no-charge preventive care screenings.  But critics of the reform law said that the administration’s new rules clamp down too hard — and would effectively eliminate the old plans many Americans have and like.

Small Firms May Not Keep Current Health Plans After White House Decision

In three years a majority of workers will be forced to change their current health insurance plans, according to draft regulations being written by the Obama Administration. Despite promises that current plans will be “grandfathered” and allowed to continue once ObamaCare is fully implemented, minor changes will qualify plans as “new” and be forced to make broad, new changes to comply with the new law. To avoid ObamaCare’s new regulations, employers might drop their employer-provided insurance altogether.

An ill-conceived provision of ObamaCare is already threatening to upend insurance policies for millions of Americans. The National Association of Insurance Commissioners reported to HHS recently that they would not meet a regulatory deadline because of the massive disruption strict adherence to the new law would precipitate. According to some sources, there is potential for millions of people to lose their insurance next year based on rules which are supposed to control premiums by regulating the amount insurers are allowed to spend on administrative costs but actually just drive insurers out of the marketplace altogether.

Toxic BP Oil Spill Fumes Will Cause Death & Cancer – Government & BP Negligent In Alerting Public

Did the Obama EPA turn away the Dutch offer for help because of a moronic rule?- The U.S. Government has apparently reconsidered a Dutch offer to supply 4 oil skimmers. Water pumped into the tanker will settle to the bottom of the tanker and is then pumped back into the ocean to make room for more oil. Each system will collect 5,000 tons of oil each day.  The Dutch offered to fly their skimmer arm systems to the Gulf 3 days after the oil spill started. The offer was apparently turned down because EPA regulations do not allow water with oil to be pumped back into the ocean. If all the oily water was retained in the tanker, the capacity of the system would be greatly diminished because most of what is pumped into the tanker is sea water.

But anyone else — large business, small business, individual — who switches carriers loses their grandfathered status.

24 Hours After Telling People in the Gulf "We're in This Together," Obama Hoops it up in Chicago

A Gulf Coast official is pleading with President Barack Obama to scrap the moratorium on new oil drilling and exploration as the investigation of the massive oil spill continues, saying the economic impact to her Louisiana parish would be too much to bear. Charlotte Randolph, president of LaFourche Parish, said she spoke to Obama in person during his visit to the oil-stricken region Friday.

Obama said Saturday that the failure of BP's latest effort to stop the damaging flow of oil into the Gulf of Mexico is "as enraging as it is heartbreaking."

Obama visited oil-stricken Louisiana, where he saw a little oil, a lot of officials but none of the local inhabitants he promised not to leave in the lurch amid the worst oil spill in US history.

The Obama Interior Department exempted BP's calamitous Gulf of Mexico drilling operation from a detailed environmental impact analysis last year, according to government documents, after three reviews of the area concluded that a massive oil spill was unlikely.

CBO Director Dr. Douglas Elmendorf refutes Obama claims about his health care legislation: For months the President and his Budget Director correctly argued that the goal of health care reform was to “bend the cost curve down.” The projected path of per capita health spending is unsustainable and will result in three bad outcomes: 1. Those with health insurance will have less money available for other needs; 2. It will be harder for the uninsured to buy insurance; 3. An e-mail from Rep. Darrell Issa's (R-Calif.) campaign suggested Wednesday that the controversy over Rep. Joe Sestak's (D-Pa.) alleged administration job offer could be President Barack Obama's Watergate scandal.

Man’s Country appears to be a “one stop shopping” center for gay men. The club’s website advertises steam rooms, “fantasy rooms,” bed rooms, male strippers, adult movies, and lockers. However, Man’s Country was not the only location for Obama’s predatory gay sex activities. The Chicago gay community is aware that Obama often made contacts with younger men at his famous “pick-up basketball” games. It was at these “pick up” matches where Obama first met Emanuel and a young Democratic campaign worker and senior bank vice president named Alexi Giannoulias.

Kagan's oral argument before the Supreme Court

Obama appointee to the Supreme Court, Elena Kagan, didn’t do her homework before arguing the Citizens United case on behalf of the Obama administration and the FEC — which her probably-soon-to-be colleagues on the Supreme Court wasted no time in pointing out.  It came at the very beginning of her oral arguement, when one might expect a Solicitor General to attempt to impress the panel with her grasp of law and precedent: the crux of the case was the issue of limiting expenditures as an expression of political speech, not contributions.  Kagan started off her argument by misconstruing the issue and then offering a factually incorrect reading of precedent.  Both Scalia and Kennedy objected to it before Kagan even had time to get the argument completed

The letter to congressional leaders

The Obama administration is no longer interested in debate of health care. The administration told congressional leaders in a letter on Monday that it has made "significant progress" implementing the health care overhaul, including a load of consumer friendly provisions that could ease negative perceptions of the plan among a skeptical public. The letter is part of an administration campaign to convey the impression that the debate is over and the health care train is leaving the station.

In a sharply worded letter to the president sent on Sunday, Braly said the characterization “grossly misrepresents” reality. Braly criticized Obama for raising the point in his weekly address on Saturday. She wrote that she was “disappointed to hear you repeat false information.” She also urged Obama to stop his attacks on health insurers.

Obama appointees rewrite the rules for airline unions

In a major victory for organized labor, unions will have an easier time signing up airline and railroad workers after the Obama administration Monday changed a 76-year-old rule on union elections. The new rule, announced by the three-member National Mediation Board, would recognize a union if a simple majority of workers who cast ballots approve organizing. The previous rule required a majority of the entire work force to favor unionizing. That meant workers choosing not to vote at all were effectively counted as "no" votes.
